South Dakota SB 62 (Data Breach Notification, codified at SDCL § 22-40)
South Dakota was among the last states to enact a breach notification law (2018) and requires notification within 60 days. The AG must be notified when a breach affects more than 250 South Dakota residents.
South Dakota residents now have full breach notification rights. Companies must notify the AG for large breaches, creating enforcement accountability and supporting civil claims.
